1. Introduction
This Refund & Returns Policy applies to all purchases made through Casks Galore via www.casksgalore.com.
Due to the distinct nature of our products, separate terms apply to:
- Whisky bottles (consumer goods)
- Scotch whisky casks (investment assets held in bonded warehouses)
By placing an order, you agree to the terms set out below.
2. Bottles – Consumer Returns
2.1 Right to Cancel (Distance Selling)
Under the Consumer Contracts Regulations 2013, you have the right to cancel your order within 14 days of receiving your goods.
To exercise this right:
- You must notify us in writing within 14 days of delivery
- Goods must be returned within 14 days of cancellation
2.2 Conditions for Returns
Returned bottles must:
- Be unopened and sealed
- Be in original packaging
- Be in resalable condition
We reserve the right to reject returns that do not meet these conditions.
2.3 Exemptions
The right to cancel does not apply where:
- The seal of alcoholic goods has been broken after delivery
- The product has been used, altered, or damaged after receipt
2.4 Faulty or Damaged Goods
Under the Consumer Rights Act 2015, you are entitled to a remedy if goods are faulty.
If goods arrive damaged or defective:
- Notify us within 48 hours of delivery
- Provide photographic evidence
We will offer:
- A replacement, or
- A full refund, including reasonable return costs
2.5 Refunds
- Approved refunds will be processed within 5–10 working days
- Refunds will be issued to the original payment method
2.6 Return Shipping
- You are responsible for return shipping unless goods are faulty
- We recommend using a tracked and insured delivery service
3. Whisky Casks – Investment Assets
3.1 Nature of Transaction
All whisky cask purchases are classified as investment-grade asset transactions, not standard consumer goods.
Each cask:
- Is a unique asset
- Is stored within an HMRC bonded warehouse
- Is subject to market fluctuations and natural maturation processes
3.2 No Right to Cancel or Return
Once a cask purchase is completed and ownership documentation has been issued:
- All sales are final
- No refunds, cancellations, or returns will be accepted
This includes (but is not limited to):
- Changes in market value
- Buyer’s financial circumstances
- Delays in resale or liquidity
- Changes in storage strategy
The statutory 14-day cooling-off period does not apply once ownership has been transferred and contractual obligations fulfilled.
3.3 Transfer of Ownership
Ownership is deemed transferred when:
- A Delivery Order (DO), warehouse record, or equivalent ownership documentation is issued
- Payment has been received in full
From this point:
- The buyer assumes responsibility for storage, insurance, and onward management (unless otherwise agreed)
3.4 Exceptional Circumstances
Refunds or replacements may only be considered where:
- The cask does not exist
- There is a material misrepresentation, including incorrect:
- Distillery
- Distillation date
- Cask type
- Legal ownership cannot be transferred
In such cases, we will:
- Investigate the matter
- Offer a replacement cask of equivalent value, or
- Provide a full refund
3.5 Natural Characteristics of Whisky Casks
Buyers acknowledge and accept that:
- Whisky matures over time and may experience evaporation loss (angel’s share)
- Alcohol strength (ABV) and volume (RLA/OLA) will fluctuate
- Flavour development is variable and not guaranteed
These natural processes are not defects and do not qualify for refunds or returns.
4. Order Cancellations
4.1 Bottles
Orders may be cancelled prior to dispatch. Once dispatched, the returns process in Section 2 applies.
4.2 Casks
Cask orders may only be cancelled:
- Before payment is completed, and
- Before ownership documentation is issued
After this point, cancellation is not permitted.
5. Important Notice – Whisky Cask Investments
Whisky casks are considered long-term, illiquid investment assets.
By purchasing a cask through Casks Galore, you confirm that:
- You understand the risks associated with whisky cask investment
- You acknowledge that values may increase or decrease over time
- You accept that resale is not guaranteed and depends on market demand
Additional considerations include:
- Ongoing storage costs within bonded warehouses
- Potential broker or resale fees
- Time required to reach optimal maturity and value
Casks Galore may provide guidance on resale strategies; however:
- We do not guarantee returns or liquidity
- We do not operate a buy-back scheme unless explicitly agreed in writing
6. Compliance with UK Law
This policy is designed to comply with:
- Consumer Contracts Regulations 2013
- Consumer Rights Act 2015
Nothing in this policy affects your statutory rights.
